Terms of Service

Effective 2026-07-04. These terms govern use of testlabindex.com (the “Site”), operated by Test Lab Index (“we”, “us”).

1. What the Site is

The Site is a factual directory compiled from public government and accreditation-body registries. Content is provided for general information only. It is not legal, regulatory or compliance advice, and it is not a recommendation of any laboratory.

2. No warranties

The Site is provided “as is” and “as available”. We work to reproduce registry records accurately and date every retrieval, but registries change and errors happen. We disclaim all warranties, express or implied, including accuracy, completeness, fitness for a particular purpose and non-infringement. You are responsible for confirming any fact with the underlying registry and the laboratory before relying on it.

3. No outcome promises

Nothing on the Site promises regulatory approval, certification, test outcomes, business results or leads — for visitors or for laboratories that claim a listing. A claimed listing buys profile management features and a dated verified-claim badge, nothing more.

4. Acceptable use

You may not scrape the Site at disruptive rates, misrepresent your affiliation when claiming a profile, or use the Site to harass any listed organization. Individual facts are not proprietary; our compilation, arrangement and presentation are protected.

5. Claimed listings, payment, refunds and cancellation

Paid claimed listings are billed monthly by our merchant of record, whose checkout terms apply to payment processing. Refund: your first charge is fully refundable on request within 14 days of that charge; later charges are non-refundable except as required by law. Cancellation: you may cancel at any time, effective at the end of the current billing period, with no cancellation fee; paid features end then and the profile remains published in its free, facts-only form. Claiming or paying never alters ranking position.

6. Corrections and removal

Any listed organization may request a correction of factual errors or complete removal of its profile at no cost via the corrections page. This is the fastest path to resolve any concern about your listing, and we commit to acting on valid requests within 5 business days.

7. Intellectual property and DMCA

If you believe content on the Site infringes your copyright, send a notice identifying the material and its location to legal@testlabindex.com. We will remove or disable access to material that is the subject of a valid notice and terminate repeat infringers.

8. Limitation of liability

To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue, data or goodwill; and (b) our total aggregate liability for all claims relating to the Site in any 12-month period is capped at the greater of US $100 or the amount you paid us in that period.

9. Binding arbitration; class waiver

Any dispute arising out of or relating to the Site or these terms that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in English, remotely where possible. You and we each waive any right to a jury trial and to participate in a class, collective or representative action. Either party may instead bring an individual claim in small-claims court. You may opt out of this arbitration clause within 30 days of first using the Site by emailing legal@testlabindex.com.

10. Governing law

These terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 9.

11. Changes

We may update these terms; the effective date above changes when we do. Continued use after a change is acceptance of the updated terms.
